Podisodic Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Podisodic app (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, regardless of the device or platform used (iOS or Android) or the country from which you access the App.

2. The Service

Podisodic is a podcast, audiobook, and audio discovery app that allows users to discover, subscribe to, follow, save, download, organize, and listen to audio content, and optionally support verified Podcast Creators with one-time tips. The App operates by:

Podisodic is free to download and use for podcast listening. Optional listener tips and any other paid features are processed separately through the applicable app store or payment provider. We reserve the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have your parent or guardian’s permission to use the App.

4. RSS Feeds, Audiobooks & Third-Party Content

4.1 Open RSS Feeds And Directories

The App accesses publicly available RSS feeds as a standard podcast player and may use third-party directories and metadata sources. All podcast, audiobook, artwork, chapter, show note, and related content accessible through the App is owned by the respective creators, publishers, narrators, authors, libraries, directories, and/or hosting providers. Podisodic makes no claim of ownership over any third-party content.

4.2 No Endorsement

Podisodic does not endorse, curate, verify, or take responsibility for any podcast, audiobook, feed, show note, transcript, timestamp, recommendation, topic result, support link, social link, or other third-party content accessible through the App. The presence of content in the App does not constitute an endorsement of its content, accuracy, source, availability, or views.

4.3 Content Availability

Content availability depends on the original creator, directory, library, platform, or hosting provider maintaining the feed, metadata, or file. Podisodic does not guarantee that any particular podcast, audiobook, episode, chapter, link, chart, recommendation, or metadata item will be available, complete, accurate, or current at any given time. We are not responsible for content that is removed, altered, or becomes unavailable at the source.

4.4 Your Responsibility

You are responsible for ensuring your personal use of content accessed through the App complies with applicable laws and the terms of the original content providers.

4.5 Offline Downloads

Where the App offers offline download functionality, downloaded episodes are stored on your device solely for personal, offline listening. Downloaded content may not be redistributed, shared, or reproduced in any form. Downloads are made directly from the original hosting provider’s servers. Podisodic does not store or cache audio files on its own servers at any point in this process.

4.6 Audiobooks

Audiobook features may display public-domain or third-party audiobook metadata and audio from sources such as LibriVox, Internet Archive, or other public feeds where available. You are responsible for confirming that your use of audiobook content is permitted in your location and by the applicable content provider.

4.7 Topics, Recommendations, And Enhanced Metadata

Topic feeds, charts, search results, recommendations, cleaned show notes, timestamps, extracted links, social/support links, and similar discovery features are provided for convenience. They may be incomplete, delayed, duplicated, miscategorized, or inaccurate.

4.8 External Links

The App may open third-party websites or services, including podcast websites, email links, social platforms, Patreon, Spotify, Apple Podcasts, hosting providers, and other external destinations. Podisodic is not responsible for the content, policies, subscriptions, purchases, ratings, reviews, or practices of those third parties.

5. Intellectual Property

5.1 Podisodic IP

The App, including its design, interface, features, and original content, is owned by Podisodic and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.

5.2 Third-Party Content

All podcast content accessible through the App is owned by the respective creators and publishers. Nothing in these Terms grants you any rights in third-party content beyond what is already permitted by the creator’s publication of their content via public RSS feed.

6. Copyright & DMCA

6.1 DMCA Compliance

Podisodic respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). We respond promptly to valid takedown notices submitted in accordance with the DMCA.

6.2 Designated DMCA Agent

If you believe that content accessible through the App infringes your copyright, you may submit a written takedown notice to our designated DMCA agent at:

To be valid, your takedown notice must include: (a) a description of the copyrighted work you claim has been infringed; (b) identification of the infringing content and its location in the App; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature.

6.3 Counter-Notice

If you believe your content was removed in error, you may submit a counter-notice to the DMCA agent above. Upon receipt of a valid counter-notice, we may restore the content after 10 to 14 business days unless the complaining party seeks a court order.

6.4 Repeat Infringers

Podisodic reserves the right to terminate or restrict access for users who are found to be repeat infringers.

7. Listener Tips

Podisodic may allow listeners to send optional one-time tips to verified Podcast Creators. Tips are voluntary in-app purchases that let listeners support Podcast Creators. Tips do not unlock premium content, subscriptions, special access, or any additional podcast content.

Listener payments are processed by the app store platform used for the purchase, such as the Apple App Store or Google Play. Your purchase is also subject to the applicable app store terms, billing rules, refund rules, and payment policies.

8. Podcast Creator Accounts, Verification, And Payouts

Podcast Creators may create a Podisodic account for Podcast Creators and claim a podcast feed. To receive tips, Podcast Creators must verify ownership of their show using the verification process provided by Podisodic. Podisodic may review, approve, reject, suspend, or revoke Podcast Creator claims if we believe a claim is inaccurate, disputed, fraudulent, unauthorized, or violates these Terms.

Podcast Creator earnings accumulate in the creator dashboard and may be paid out monthly once minimum payout requirements are met. Podcast Creators must provide accurate payout information before receiving payouts. Podcast Creator payouts are based on eligible settled tips after applicable platform fees, Podisodic fees, refunds, reversals, chargebacks, fraud checks, and minimum payout requirements.

Unless otherwise stated, tips are subject to the platform fee charged by Apple or Google for payment processing and a Podisodic fee to cover operating costs. Current Podcast Creator-facing materials may describe these as a 15% Apple/Google fee and a 5% Podisodic fee. Fees, payout timing, minimums, and payout availability may change over time, including if app store rules, platform fees, payment provider rules, or our operating costs change.

9. Tip Messages And User Content

Listeners may have the option to add a short message or display name when sending a tip. These fields are optional and are intended to be shown privately to the Podcast Creator in their creator dashboard or support activity tools. They are not intended for public display in the App.

You are responsible for any message or name you submit. You may not submit content that is illegal, abusive, harassing, hateful, threatening, explicit, misleading, infringing, spam, or otherwise harmful. Podisodic may remove, hide, restrict, or refuse to deliver tip messages or related account activity if we believe it violates these Terms, platform rules, law, or our safety standards.

10. Tips, Refunds, And Payment Issues

Refund requests, duplicate charge issues, failed payment issues, and billing disputes should generally be submitted through the applicable app store platform. Podisodic may help investigate support records, but Apple or Google may control the final refund or billing decision for purchases processed through their platforms.

If a tip is refunded, reversed, charged back, or otherwise not settled, Podisodic may reverse the related Podcast Creator earnings, deduct the amount from future Podcast Creator payouts, or delay payout until the payment is settled.

Podisodic may delay, withhold, reverse, or refuse tips or payouts if we believe a transaction violates these Terms, platform rules, law, or is fraudulent, abusive, mistaken, unauthorized, or creates operational risk.

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. Podisodic does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Podisodic is not responsible for the content, accuracy, or legality of any podcast, audiobook, link, recommendation, topic result, show note, timestamp, rating, review destination, or other third-party content accessible through the App. We do not pre-screen or monitor all third-party content.

Notifications, background refreshes, downloads, playback state, recommendations, and diagnostics may be delayed, incomplete, or unavailable due to device settings, network conditions, third-party services, operating-system behavior, or provider availability.

13. Limitation of Liability

To the fullest extent permitted by law, Podisodic and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the greatest extent permitted by applicable law.

The App integrates with third-party services including:

15. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in the Privacy Policy.

16. Local Downloads And Device Storage

Podisodic may store certain information locally on your device, including subscriptions, playback history, resume positions, cached podcast metadata, playlists, and downloaded episode audio and file paths. You are responsible for managing content stored on your device, including deleting downloads when desired.

17. User Libraries, Likes, Topics, And Sync Features

Features such as subscriptions, saved audiobooks, followed topics, likes, playlists, queue state, recent searches, and notification preferences may be stored on your device and may also be synced or processed through backend services to support app functionality described in the Privacy Policy. Like counts, topic counts, saved state, and similar metadata may be delayed or eventually consistent across devices or services.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. For users outside the United States, local laws may also apply and nothing in these Terms limits your statutory rights under applicable local law.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction in the United States, as applicable.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
